1. PURPOSE
This Acceptable Use Policy (“AUP”) sets out the rules governing the use of the Fiatope platform (www.fiatope.com), a crowdfunding platform operated by the Fiatope Association (French law of 1901). It applies to all users, project owners and contributors, and supplements our Terms of Use.
Fiatope uses Stripe’s services to process payments. As such, this AUP is designed to comply with Stripe’s Prohibited and Restricted Businesses list, available at: https://stripe.com/legal/restricted-businesses. By using Fiatope, you agree to abide by these rules.
2. PROHIBITED ACTIVITIES
In accordance with Stripe’s rules and our own ethical standards (see our “Values and Ethics” charter), projects and contributions must not involve any of the following activities:
- Illegal products or services: any project contrary to the laws and regulations applicable in the country of the project owner or the contributor;
- Counterfeiting and intellectual property infringement: copied or counterfeit products, or content infringing the copyrights, trademarks or patents of third parties;
- Regulated or dangerous products: weapons, ammunition, explosives, narcotics, psychotropic substances, tobacco, unauthorized medicines, uncertified medical devices;
- Adult content: pornography, services of a sexual nature;
- Gambling and betting: lotteries, casinos, sports betting, games of chance;
- Unlicensed financial services: lending, money transfer, currency exchange, cryptocurrencies, investments promising returns, where the project owner does not hold the required regulatory approvals;
- Unfair remuneration schemes: pyramid schemes, “get rich quick” multi-level marketing programs;
- Discrimination and hate: any content that promotes hatred, violence, or discrimination against any person or group;
- Fraud and deception: fictitious projects, misleading information, misuse of contributors’ trust;
- Fundraising for illegal or violent activities;
- Online pharmacies and remote sale of pharmaceutical products without authorization.
This list reflects the main categories of Stripe’s restricted-businesses list. In case of any discrepancy, Stripe’s list prevails.
3. RESTRICTED ACTIVITIES
Certain activities are not prohibited but require prior written approval from Stripe and/or Fiatope before any fundraising. These include, but are not limited to:
- travel services, including bookings and stays;
- the sale of alcohol;
- sanctioned goods (works of art, videos, events, etc.);
- nutrition, dietary supplement and wellness services subject to regulation;
- fundraising for non-profit or charitable organizations.
Any project falling within these categories must be declared to Fiatope upon submission. Fiatope reserves the right to request additional documentation or to refuse the fundraising campaign.
4. CONTROLS CARRIED OUT BY FIATOPE
To enforce this AUP, Fiatope:
- reviews each project before it goes live and may request identity documents and supporting evidence (KYC process) from project owners;
- maintains an up-to-date internal list of prohibited or restricted activities, consistent with the rules of its payment processors;
- may suspend or remove any project or contribution in violation at any time, and block the accounts of the users concerned;
- cooperates with Stripe and the competent authorities in the event of suspected illegal activity.
5. PENALTIES FOR VIOLATIONS
In the event of a breach of this AUP, Fiatope reserves the right, without prejudice to the rules applicable under ordinary law, to: (i) refuse to put a project online; (ii) suspend or withdraw an ongoing fundraising campaign; (iii) ask Stripe to confirm, cancel or challenge a payment where applicable; (iv) close the account of the user concerned. No compensation may be claimed from Fiatope as a result of the application of these rules.
6. REPORTING AND CONTACT
Any user may report to Fiatope any project on the platform that may contravene this AUP. Any questions regarding this AUP may be sent via the Contact page of the site, or by mail to the registered office of the Fiatope Association (110 rue Pierre Brossolette, 92320 Châtillon, France).
